Fair Path Terms and Conditions

1. Agreement to These Terms

 

These Terms and Conditions ("Terms") are a binding agreement between you and Fair Path Labs, Inc., operating as The Fair Path Project ("Fair Path," "we," "us," or "our"). They apply to your use of our website, fairpathproject.com, and to the tools, courses, coaching, events, and other services we offer (together, the "Services").

 

By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

 

2. What Fair Path Is and Is Not

 

Fair Path helps workers understand their workplace rights and document what is happening to them. We also offer coaching, online courses, and professional development for HR professionals, attorneys, and organizations.

 

Fair Path is not a law firm. We do not give legal advice, and we do not evaluate, assess, or place a value on anyone's legal claim. Using our website, tools, or services does not create an attorney-client relationship with Fair Path. Information on our website, in our tools, and in our courses is for general information and education only. It is not a substitute for advice from a licensed attorney about your situation. If you need legal advice, please consult an attorney.

 

Coaching is not therapy, counseling, medical care, or legal advice.

 

3. Eligibility

 

Our Services are intended for adults 18 and older who are located in the United States. By using the Services, you confirm that you are at least 18 years old and that you have the legal capacity to agree to these Terms. If you are using the Services on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.

 

4. Our Services

 

Depending on how you use Fair Path, the Services may include:

 

- Our website and state-by-state resources

- Documentation tools

- The Fair Path chat assistant

- Coaching sessions booked through our website

- Online courses, including courses hosted on Thinkific

- Our AI coaching service

- The Bully Boss avatar practice tool

- Events, webinars, and conferences

 

We may add, change, or discontinue any part of the Services at any time. Some Services are provided through third parties, and those third parties may have their own terms, which apply in addition to these Terms.

 

5. AI Tools

 

Some Fair Path Services use artificial intelligence, including the chat assistant, our AI coaching service, and the Bully Boss avatar practice tool. When you use these tools, you are interacting with an AI and not with a person.

 

AI tools can make mistakes. Their responses may be incomplete, inaccurate, or out of date. They do not provide legal advice, and they do not evaluate your legal claim. You are responsible for deciding how to use any output, and you should not rely on it as a substitute for advice from a licensed attorney or other qualified professional.

 

The Bully Boss avatar practice tool is operated by Simulus AI Advisors, a third-party provider. Your use of that tool is also subject to Simulus's own terms and Privacy Policy.

6. Accounts

 

Some Services, such as courses and the avatar practice tool, may require you to create an account. You agree to provide accurate information, to keep your login details confidential, and to tell us promptly if you believe your account has been used without your permission. You are responsible for activity that happens under your account.

 

7. Your Content

 

"Your Content" means anything you submit through the Services, including messages to the chat assistant, files you upload, and coursework or exercises you submit for feedback.

 

You keep ownership of Your Content. You give Fair Path a limited license to use, store, and process Your Content only as needed to provide and operate the Services, as described in our Privacy Policy. You confirm that you have the right to submit Your Content and that doing so does not violate anyone else's rights or any law.

 

Please share only what you are comfortable sharing. Do not upload information that you do not have the right to share, such as another person's confidential records.

 

8. Acceptable Use

 

You agree not to:

 

- Use the Services for any unlawful purpose

- Harass, threaten, or abuse Fair Path staff, coaches, other users, or others

- Submit content that is false, defamatory, or that infringes anyone's rights

- Attempt to gain unauthorized access to the Services, other accounts, or our systems

- Interfere with or disrupt the Services or their security

- Use bots, scrapers, or other automated means to access the Services, except as we allow

- Copy, resell, or redistribute course materials, tools, or other content except as these Terms allow

- Share your account or course access with others

- Use the AI tools to generate content that is unlawful or harmful, or try to circumvent their safeguards

- Misrepresent your identity or your affiliation with any person or organization

 

We may suspend or end your access if we reasonably believe you have violated these Terms.

 

9. Courses, Coaching, and Continuing Education Credit

 

Course enrollment gives you a personal, non-transferable right to access the course for an unlimited period. Course materials are for your own use.

 

Coaching sessions are scheduled through our website. Please cancel or reschedule at least 24 hours before your session. Sessions cancelled with less notice, and missed sessions, are forfeited. If you buy a package of sessions and cancel within 14 days of purchase before your first session, you will receive a full refund. Once a session has taken place, unused sessions in the package are refunded at the package's per-session price. 

 

If you ask us to report continuing education credit to HRCI or SHRM, we will share the information required for that purpose. The Anti-Workplace Bully Blueprint for HR is approved for credit and Beyond the Protected Class may be approved for CLE credit through certain states.  

Completion of a course does not guarantee certifying agencies or bodies will grant credit.

 

10. Payments and Refunds

 

Prices for courses, coaching, and other paid Services are shown at the time of purchase. Payments are processed by our payment providers, including Stripe. By making a purchase, you authorize us and our payment providers to charge the payment method you provide.

 

For online courses. You may request a full refund within 14 days of purchase, as long as you have completed no more than 30 percent of the course. After 14 days, or once you have completed more than that, purchases are non-refundable. If you asked us to report continuing education credit to HRCI, SHRM, or another body, the purchase is non-refundable once the credit has been reported. If a technical problem on our side prevents you from accessing a course and we cannot fix it, you may request a full refund at any time. 

Events, webinars, and conferences. Refund terms are stated at registration.

Custom engagements. Consulting and executive engagements are governed by the written agreement for that engagement.

 

11. Intellectual Property

 

The Services, including the website, courses, frameworks, assessments, tools, text, graphics, logos, and videos, are owned by Fair Path or its licensors and are protected by intellectual property laws. Except for the limited rights described in these Terms, we do not give you any rights in them.

 

You may view and use the Services for your own personal or internal professional development. You may not copy, modify, distribute, sell, or create derivative works from our materials without our written permission. The Fair Path name and logo are ours, and you may not use them without our written permission.

 

If you believe content on the Services infringes your copyright, contact us at the address in Section 19. 

 

12. Third-Party Services and Links

 

The Services rely on and link to third-party services, including Wix, Anthropic, Coachvox, Thinkific, Simulus, Stripe, YouTube, Instagram, Facebook, and LinkedIn, as well as government agencies and partner organizations. We do not control these third parties and are not responsible for their content, availability, or practices. Your use of them is governed by their own terms and policies.

 

13. Privacy

 

Our Privacy Policy explains how we collect, use, and share personal information. By using the Services, you acknowledge that you have read it.

 

14. Disclaimers

 

The Services are provided "as is" and "as available." To the fullest extent the law allows, Fair Path disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, secure, or error-free, or that any information or AI output will be accurate or complete.

 

We do not guarantee any outcome from using the Services, including the result of any workplace matter, claim, negotiation, or career decision.

 

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

 

15. Limitation of Liability

 

To the fullest extent the law allows, Fair Path and its officers, directors, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of opportunity, arising out of or related to your use of the Services.

 

To the fullest extent the law allows, our total liability for any claim relating to the Services will not exceed the amount you paid Fair Path in the 12 months before the claim.

 

16. Indemnification

 

You agree to defend and indemnify Fair Path and its officers, directors, employees, and contractors against claims, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, Your Content, or your misuse of the Services. 

 

17. Termination

 

You may stop using the Services at any time. We may suspend or end your access at any time, including if you violate these Terms. Sections that by their nature should continue after termination, including those on intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will continue to apply.

 

18. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws rules.

Informal dispute resolution. Before either of us files a legal claim, we both agree to try to resolve the dispute informally. If you have a dispute with Fair Path, please send a written notice to [enter email address] that includes your name, the email address you used for the Services, a description of the dispute, and what you are asking for. We will work with you in good faith to resolve it. If we have not resolved the dispute within 30 days after we receive your notice, either of us may file a claim. Fair Path will send any notice to you at the email address associated with your account or purchase.

Venue. Any claim that is not resolved informally must be brought in [enter the court and location you confirmed], and you and Fair Path consent to the jurisdiction of that court.

No arbitration. Nothing in these Terms requires you to arbitrate any dispute. Either of us may also bring an individual claim in small claims court if it qualifies.

Class action waiver. To the fullest extent the law allows, you and Fair Path each agree that claims may be brought only on an individual basis, and not as a plaintiff or class member in any class, collective, or representative action. If a court finds this waiver unenforceable as to a particular claim, that claim will proceed in court, and the rest of these Terms will remain in effect.

20. Changes to These Terms

 

We may update these Terms from time to time. We will post the updated Terms on this page and update the date at the top. If we make material changes, we will notify you through a notice on our website. Your continued use of the Services after the changes take effect means you accept the updated Terms.
